"If the President chooses not to certify Iranian compliance, that does not mean the United States is withdrawing" from the deal, US ambassador Nikki Haley told the American Enterprise Institute think tank in Washington. However, she added, if the president decides to reject the agreement now, he "has grounds to stand on". "Withdrawal from the agreement is governed by the terms of the JCPOA", Haley added.

But, Ms. Pletka said, "it is, frankly, a little odd to see the president of the United States punt his constitutional prerogatives down Pennsylvania Avenue" to Congress. Haley all but declared in her speech that the Iranians were guilty if they weren't rushing to open up the additional sites, and the IAEA was weak for not demanding it. "What happens next is significantly in Congress's hands", Haley said. And, Haley argued, both United Nations resolutions and USA law should be considered as well.

Tehran recently dismissed murmurings from the United States about possible nuclear inspections, with Iranian President Hassan Rouhani saying that such investigations are not necessary under the terms of the accord.

Following Iran's ballistic missile tests in February, president Trump said "nothing is off the table" in dealing with Tehran.

Haley said the 2015 deal was "very flawed and very limited", but that she was not proposing its decertification. The Iranians denied the missile was created to carry a nuke, and a lack of "consensus" about the testing and whether this provision in 2231 was even binding, prevented further action. You can call it "non-nuclear" all you want - missile technology cannot be separated from pursuit of a nuclear weapon.

Though Haley was careful to note that she was not calling for the United States to actively withdraw from the Joint Comprehensive Plan of Action (JCPOA), she offered a selection of "alternative facts" and carefully phrased arguments clearly aimed at justifying President Trump's desire to do just that.

"We must consider the whole jigsaw puzzle, not just one of its pieces".

Under U.S. law, President Donald Trump must certify every three months whether Iran is in compliance with the agreement's ban on developing nuclear weapons and related restrictions.

"Another major flaw in the JCPOA is its penalty provisions", she said. "It said, 'We've made this deal on the nuclear side, so none of the regime's other bad behavior is important enough to threaten the nuclear agreement'".

"Everyone hoped the deal would make the Iranian government good people", Haley said, "but no one looked at the history of Iran, no one looked at all the past aggressions they have shown". However - and this is key - do we have any confidence this administration is equipped to negotiate new provisions, keep allies on board and not induce Iran to leave the deal in such a fashion as to appear the sympathetic victim of USA double-crossing?
