Also late Tuesday evening, arbitrator Harold Henderson upheld the league's six-game suspension following last week's appeals hearing in NY.

ESPN's Chris Mortensen reported at 7:25 p.m. that Elliott's six-game suspension has been up held by arbitrator Harold Henderson.

The NFL Players' Association sued in federal court on behalf of Elliott last week before Henderson ruled, saying the appeal hearing was "fundamentally unfair" because the running back was prevented from confronting his accuser in the OH case. Judge Amos Mazzant said he will make a decision on Elliott's temporary restraining order by Friday at 6 p.m. ET.

Attorneys for the league said in federal court in Texas that Elliott will be eligible to play for the Cowboys against the New York Giants in Sunday night's nationally televised opener in Arlington, Texas.

But if Elliott's suspension is upheld and he is forced to miss six games, then the advantage of having him play in an important division matchup is washed away by the fact he would miss the October 29 meeting against the Washington Redskins.

The Elliott situation is messy, so whether Dickerson believes his suspension is just, is somewhat irrelevant. The NFL responded with a motion to dismiss the NFLPA's petition, arguing that the union's lawyers improperly acted before Henderson could reach a ruling in the case. The NFL says it found "credible evidence" that Elliott used physical force on the woman involved. However, NFL Commissioner Roger Goodell determined his actions constituted a violation of the NFL's personal conduct policy. A ruling isn't expected until Friday. While the NFLPA cited this as new evidence during the appeal, Henderson wrote that Roberts' views were in the investigative report Goodell reviewed before his suspension decision. Citing extensive digital evidence as well as the testimony of Elliott's accuser and medical experts who examined photographs of her injuries, the National Football League levied its six-game ban on August 11. Elliott's suspension came after claims he was involved in a domestic abuse incident.

Lockhart also disputed key aspects of a report by The Fort Worth Star-Telegram last week: that Lisa Friel, the league's senior vice president of investigations, barred Roberts from the meeting in which Friel recommended a six-game suspension to Goodell; and that Roberts testified in the appeal hearing that she recommended no discipline.

Elliott played his first career game against the Giants and had 20 carries for 51 yards and a touchdown.

Elliott will fight the suspension to victory or the complete exhaustion of his legal options, a source close to the running back told Yahoo Sports. That's a huge loss considering he had one of the great seasons ever for a rookie running back in 2016 with a league-leading 1,631 yards to go with 15 touchdowns.

No one should be surprised if Elliott follows Brady's legal blueprint and gets his suspension delayed until after the 2017 season.
